This customer's Privacy Statement is effective as of May 12, 2021. This privacy statement will be updated regularly to reflect any changes in the way Brickwork India Pvt. Ltd. ("Brickwork") handle its customer's personal data or any changes in applicable laws.

    Brickwork is a professional services firm focused on delivering business support solutions to its customers globally. Brickwork strongly advocates the protection of its customers' personal data and have adopted policies and procedures that effectively capture its commitment to customers.

    This customer's Privacy Statement helps its customers to understand why, what, and how Brickwork collect, use, store, disclose, protect, update, and delete the personal information received from the customers.

    This customer's Privacy Statement applies to any customer who is a natural or legal person who intends to use Brickwork services as given in its website www.Brickworkindia.com. The scope of this Statement is limited to the "Personal Information" solicited by Brickwork and provided voluntarily and with consent by the customers. Brickwork will not be liable for any unsolicited information provided by the customers.

    "Personal Information" refers to any information that helps to identify the person who is the subject of the information. For the purposes of this privacy statement, 'Personal Information' is any data which relates to an individual who may be identified from that data, or from a combination of a set of data which is in possession of Brickwork. By accepting and executing Brickwork's terms of services, customers permit Brickwork to use their data as required for Brickwork to deliver its services to them.

    Where Brickwork act as a processor in its capacity of providing services to a customer, it will only process personal data in accordance with the instructions of the customer (Data Subject and/or Data Controller). The customer may be the data controller and/or the data subject of their personal data and will be responsible for the way in which they want their personal data to be processed. Where applicable, in accordance with data protection laws Brickwork shall assist the data controller in effecting data subject rights.

  3. What information we collect and how we collect it

    1. Website Inquiry Form:

      Information that customers voluntarily provide when they register on Brickwork's website e.g., Name, Job title, Company name, Website URL, City, Country, Email, Phone, Zip code. By entering the above information and details of an inquiry in Brickwork's website, customers enable Brickwork to respond to a general/ business inquiry made by them or on behalf of themselves or the company that they represent.

    2. Call recordings & chat screenshots:

      Brickwork may record the conversations between customers and Brickwork's employees through any communication platform, related to discussion about its services, for quality and training purposes and to facilitate resolution of any queries or complaints. All call recordings will be managed in such a way, that the rights of the data subject (Customer) can be fulfilled, and all the obligations of the data controller (Brickwork) are observed as per Brickwork's privacy statement and call recording policy.

    3. Events:

      From time to time, Brickwork may attend various sales, marketing and thought leadership events, either in person or virtually, where it may collect customer's name, email address, contact number, designation/job role and the company they represent from such events. As part of these events, Brickwork sales executive and business leaders may receive business cards from them to establish a working relationship with them or the company that they represent.

    4. Information obtained from our business leaders:

      Brickwork may receive information related to customer name, company they represent, designation/job role and email address from its business leaders who have established professional/ personal connections with the customers.

    5. Information obtained from public sources and professional networking platforms:

      Brickwork may also collect information like customer name, company they represent, designation/job role, and email address from public sources but not limited to, social media and other websites that enable social sharing, and directories or registries to ensure the accuracy and completeness of customer's personal data.

    6. Information received prior to/during fulfilment of contractual services:

      Brickwork may collect information related to customer business, and sensitive or non-sensitive personal data of customer/their colleagues/partners/customers that they provide to Brickwork, during the Request for Proposal stage, proposal discussions, contract negotiations and/or the duration of time for which Brickwork provides its services.

  4. Cookies

    Brickwork has not enabled "cookies" in its website and do not track visitor's information.

    Brickwork use Google Analytics, to analyse visitor behaviour to improve the website design and navigation. Brickwork captures only the aggregated information that, by itself, does not permit the identification of individual persons (like statistics relating to visitors to our website). This information is used to perform routine website maintenance and to generate aggregate web site traffic reports to develop site content and features of value to customers and to provide general statistics regarding the use of BrickworkIndia.com.

    Our customer video testimonials are hosted in YouTube. So, Google collect the content we create, upload, or receive from others when using their services.   5. Why we collect and how we use personal information

    Brickwork collect and use only the information needed for legitimate business interest in commercial activities without infringing on customer's fundamental interests of protecting their data exposure. Brickwork use their information mainly to meet its contractual obligations to customers or in anticipation of entering a contract with them.

    Lawful bases include consent (where customer has given consent), contract (where processing is necessary for the performance of a contract with the customer (e.g., to deliver the Services they have requested) and "legitimate interests" where Brickwork need to comply with a legal or regulatory obligation.

    1. Service delivery:

      To carry out the services for which Brickwork has been contracted to deliver, and to contact customer for customer care related purposes including regular communication regarding project status, notifying issues/concerns, sharing project deliverables and carrying out day-to-day project activities, billing and administration in order to comply with Brickwork's contractual obligations towards them or the company they represent.

    2. Quality control:

      Brickwork will send surveys to customers to gather their feedback for tracking their satisfaction, to improve internal quality control and security measures, improving, upgrading, or enhancing its services.

      Brickwork may record all conversations/interactions between customer and its employees for quality and training purposes, and in pursuit of its legitimate business interests. Brickwork will always inform customer and obtain their verbal consent prior to recording any such sessions.

    3. For sales and marketing:

      Brickwork seeks customer's consent to receive any sales and marketing communication. If they would like to opt-out of receiving direct marketing communications from Brickwork, they may unsubscribe, and Brickwork will stop sending any further emails.

      Brickwork sends service and organizational updates and run marketing or promotional campaigns to create brand awareness and generate demand.

These service providers are required for Brickwork to provide services to customers and include the following:

      • Support Services: payment gateways to facilitate online payments; data security and IT experts for website maintenance and performance monitoring, analysis, audit, payments, fraud detection; data hosting and research.
      • Service partners: Partners who provide services to Brickwork's customers.

    Brickwork is headquartered in India and is the data processor processing customer's personal information. Brickwork process, store, and use customer data in India and may have laws which are different from the laws of customer's own country.

  8. Data storage & security

    Brickwork holds an ISO27001 certification, which indicates that Brickwork adheres to the highest and strictest information security standards. This is a security certification awarded by UKAS and is the only auditable international standard that defines the requirements for an Information Security Management System ("ISMS") and confirms that Brickwork's processes and security controls provide an effective framework for protecting its customers' and its own information.

    Brickwork has put in all reasonable measures to keep customer's personal data secure and confidential as listed below:

    • Data Storage in Brickwork's internal database located in its delivery centre and in Salesforce platform.
    • Limiting role-based access to customer's personal information to its employees and or authorised 3rd parties, only to the extent required for them to provide the services to the customer.
    • Anyone with the access to customer information is subject to strict contractual confidentiality obligations and Code of Conduct.
    • Steps to ensure that all dealings with personal information are processed fairly and lawfully and are kept secure against unauthorized or unlawful processing, accidental loss, destruction, or damage, as per the prescribed standards.
    • Regular monitoring, updating and testing of Brickwork's technology for possible vulnerabilities and security breaches to ensure the continued integrity of its systems.
    • Review of information collection, storage and processing practices, including physical security measures, to prevent unauthorized access to Brickwork systems.
  9. Data retention

    Brickwork will only keep customer's personal data for as long as is reasonably necessary taking into consideration its purposes outlined above or to comply with legal, accounting or reporting requirements under applicable laws. Brickwork will delete data, as per its record retention policy. To determine the appropriate retention period for personal data, Brickwork consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of personal data, the purposes for which Brickwork process the personal data and whether it can achieve those purposes through other means, and the applicable legal requirements.

    Customers have certain rights with respect to their personal data, including those set forth below.

    1. Data accuracy:

      Brickwork maintain the personal information customer supply exactly as they have provided. Customers can request that their personal data be rectified if it is inaccurate or incomplete.

    2. Restriction on usage:

      Customers can request Brickwork to restrict the processing of their personal data in certain circumstances.

    3. Data erasure:

      Customers can request Brickwork to delete their personal data (if it is no longer necessary to provide services to them). However, minimal personal data such as first name, last name, company name, invoicing address, email Id will be retained to meet Brickwork's financial, regulatory and legal obligations.

    4. Withdrawing consent:

      While Brickwork relies on customer's consent to process their personal data for legitimate interests, customers have the right to withdraw their consent at any time by writing an email to privacy@brickworkIndia.com or may withdraw their consent at any time by just clicking on the "unsubscribe" link at the end of the emails that Brickwork send you. Please note that this will not affect Brickwork's right to process personal data obtained prior to the withdrawal of the consent, or its right to continue parts of the processing based on other legal bases than customer's consent.

    5. Data portability:

      Customers can request for a copy of their personal data provided by them in a machine-readable form. They can contact Brickwork at privacy@brickworkIndia.com. and Brickwork will consider the request in accordance with applicable laws.

  11. Grievance

    Despite Brickwork's commitment and efforts to protect customer personal data, if customer still believe that their data privacy rights have been violated, or have suggestions to improve Brickwork's privacy protection measures, they are encouraged and welcomed to seek resolution of their complaints/suggestions by writing to privacy@brickworkIndia.com. All grievances shall be redressed as expeditiously as possible.

    This customer's Privacy Statement was last updated on May 12, 2021. Brickwork reserves the right to update this Statement at any time, without notice and any changes will be effective upon posting. Please be assured that Brickwork will not reduce customer's rights under this Privacy Statement without their explicit consent.

    If there are substantial changes to the way Brickwork treat customer's personal information, it will display a notice in their website. Brickwork may also notify customer by email, in its discretion, however Brickwork would recommend that customer should look at this Privacy Statement from time to time to check for any updates.
